Every building with three or more dwelling units, and every one- or two-family whose owner does not live in it, must register with HPD annually by 1 September.

The consequence that decides deals is procedural rather than financial: an owner who is not registered cannot maintain a non-payment or holdover proceeding in Housing Court, and cannot collect rent through it, until the registration is cured. Check the registration's expiry as part of diligence, not after a tenant stops paying.
